Premier
The Hangberg Peace Accord was made an order of the court on 19 October 2011. The Peace Accord and the court order established a community forum known as the Peace and Mediation Forum (PMF). With regard to the PMF:
(1) Whether he has met with the PMF, (a) if so, (i) when did those meetings take place, (ii) what were the agenda items of those meetings, (iii) what recommendations were made or what decisions were taken at those meetings and (iv) can copies of the minutes of those meetings be made available; if not, why not; and (b) if not, (i) why not, (ii) has he been represented at any of the meetings of the PMF, (iii) what were the agenda items of those meetings, (iv) what recommendations were made or what decisions were taken at those meetings and (v) can copies of the minutes of those meetings be made available; if not, why not;
(2) whether the PMF has been properly constituted; if not, why not; if so, what are the relevant details;
(3) when did the community of Hangberg hold an annual general meeting (AGM) to elect their PMF representatives;
(4) if the PMF has not been elected at regular AGMs attended by the
community, on what basis do the representatives meet with the Premier or his staff?
1)(a)(i) Yes, the Premier met with the Hangberg Peace and Mediation Forum (HPMF) during the meeting of the Hangberg Coordinating Committee meeting. The Hangberg Coordinating Committee is the structure, in terms of the Hangberg Peace Accord, where both the Premier and the Executive Mayor meets with HPMF. The Premier’s first Coordinating Meeting was on the 7th of October 2019. The Coordinating Meetings are either chaired by the Premier or the Executive Mayor. In this instance, the Executive Mayor chaired the meeting.
- The agenda for the meeting is attached as Annexure A
- The recommendations were:
- Cllr JP Smith will liaise with the Community around the High Court violators and get the Special Investigations Unit to assist with outstanding cases that are still open at Hout Bay Police Station. It is recognised that the Police station is not very functional, and is one of the least functional police stations in the City.
- Hout Bay Harbour Development to be added to the agenda as a standing item.
- Cllr Roberto Quintas of the City to liaise with Law Enforcement to demolish illegal structures next to Little Angels Educare.
- Susan Groenewald of the City will assist in translating the timeframes of the HIDA project that will be shared with the community of Hangberg in English and Afrikaans.
- Executive Mayor Dan Plato to meet with the Hangberg community and the Film Industry on how they can work together for an economic plan related to Tourism in Hout Bay.
- The Executive Mayor proposed that Economic Development must be invited to future Hangberg Coordinating Meetings.
- The Abalone project of Hangberg to be directed to Ald Vos of the City, and Provincial Department of Environmental Affairs for assistance when needed.
- The Premier proposed that a land risk analysis must be done in relation to Hangberg – he suggested the Minister of Environmental Affairs to assist this process.
(iv) Yes, copy of the minutes is attached as Annexure B
(1)(b)(i)(ii)(iii)(iv)(v) Regarding questions (b) (i) to (v), the Premier does not attend, nor
was he ever invited to, any other meetings with HPMF. The Premier meets with HPMF, and other role players in the Peace Accord, only during scheduled Hangberg Coordinating Committee meetings.
(2) Whether the PMF has been properly constituted; if not, why not; if so, what are the relevant details;
Yes – PMF is properly constituted. On 13 October, 2020, at a Special General Meeting (SGM) the current Office Bearers were elected for a new four-year term in office. The minutes of the said SGM are still being drafted by the Secretary of the HPMF.
(3) When did the community of Hangberg hold an annual general meeting (AGM) to elect their PMF representatives;

(4) If the PMF has not been elected at regular AGMs attended by the community, on what basis do the representatives meet with the Premier or his staff?
Since 2014 until 2016, HPMF has always been an interim structure, until they sorted out their NPO Certificate. However, in 2016 HPMF became properly constituted for a two-year term, which ended in 2018.
When HPMF wanted to run an AGM again in 2018 to reconstitute the structure, as the term of office for the Office Bearers had expired, the AGM was aborted. Once again, from 2018 to 2020, HPMF was back to being run by interim Office Bearers, until they were confirmed by the Electoral College (membership) on the 13th October 2020 in a SGM. The SGM also adopted amendments to the HPMF Constitution, which changed the term of office to four years, instead of two years. The current Office Bearers are in their first year of their four-year term.
