With reference to the reply to question 20 of 23 April 2021:
102 cases of sexual misconduct involving learners have been registered over a six-year period.
- (a) How many of these cases have been reported to the Department of Social Development and (b) how many of these cases have been reported to the South African Police Service;
- whether any of these cases have resulted in the perpetrators being prosecuted; if so, what are the relevant details;
- what screening process has been implemented to protect learners against sexual violence or harassment;
(a) with regard to the allegations of sexual misconduct, was it made against (i) teachers, (ii) administrators or (iii) other learners and (b) what are the details of each?
(a) All cases were reported to the Department of Social Development.
(b) The WCED does not report these incidents to SAPS. Disciplinary and criminal proceedings are separate. The onus is on the victim or the victim’s parents/guardians to institute criminal proceedings.
(2) The WCED does not hold court or police records.
(3) A standard vetting process is in place for all appointees, which includes applicants being required to provide police clearance to prove that they have no record of criminal offences or sexual offences against children.

Sexual assault includes rape, inappropriate touching and kissing.
Sexual harassment may include unwelcome physical, verbal or non-verbal conduct.
