With regard to the City of Cape Town’s Municipal Police Service, in terms of section 64(C)(2)(g) of the South African Police Service Act, 1995 (Act 68 of 1995), the executive head of the municipal police service must develop an annual police plan for the following financial year before the end of each financial year:

  1. Whether the Minister’s office received a plan for the financial year from 1 July 2020 to 30 June 2021; if not, what steps, if any, did the office take in terms of section 64 of the Act; if so, (a) when did the office receive the plan and (b) can a copy be provided;
  1. whether the Minister’s office received a plan for the financial year from 1 July 2021 to 30 June 2022; if not, what steps, if any, did the office take in terms of section 64 of the Act; if so, if so, (a) when did the office receive the plan and (b) can a copy be provided;
  1. if the City submitted an Annual Police Plan for each of the financial years mentioned above, whether each of these plans was approved by the Minister;
  1. whether any of the annual police plans includes references to the City’s Safety and Security Investigation Unit (SSIU); if so, (a) in which years was the SSIU included in the Annual Police Plan and (b) what were the role and functions of the SSIU as described in the annual police plans?

 

Answer Body: 

3.      (1)   Yes, a copy of the approved plan for 1 July 2020 to 30 June 2021 was received by the Minister of Community Safety.

                 (a)     The exact date is unknown.

                 (b)     Yes, a copy of the approved plan is attached.

         (2)   Yes, a copy of the approved plan for 1 July 2021 to 30 June 2022 was received by the Minister of Community Safety.

                 (a)     The exact date is unknown.

                 (b)     Yes, a copy of the approved plan is attached.

                  (3)   The plans were not approved by the Minister of Community Safety as Section 64 of the South African Police Services Act, (Act 68 of 1995) does not require the Minister to approve such plans. The Head of the Cape Town Metro Police Department indicated that the Western Cape SAPS Provincial Commissioner is the approver of the plan and issues the approval certificate.

         (4)   The Head of the Cape Town Metro Police Department indicated that the City’s Safety and Security Investigation Unit (SSIU) is not referenced in any reports, as they do not fall under the command of the Cape Town Metro Police Department.
