9 (1)   Yes, the Wellington landfill site is legal and has an environmental authorisation Permit 16/2/7/G100/D4/Z1/P263, dated 28 April 1997, issued by the Department of Water Affairs and Forestry to the Wellington Municipality (now incorporated in the Drakenstein Municipality) in terms of Section 20 of the Environmental Conservation Act, 1989 (Act No. 73 of 1989) for the operation of the Wellington WDF, on Portion 34 of the Municipal Commonage, division of Wellington.

(2)  Yes, steps have been taken to ensure compliance with waste management legislation and the above-mentioned environmental authorisation. Quarterly internal and external audits are conducted on this facility by Drakenstein Municipality and the audit reports are submitted to the Department for assessment. The Department also conducts audits on the facility and the most recent audit was conducted on 10 August 2016 where the facility received a compliance rating of 92.9%, which indicates that the facility is fully compliant.  The Drakenstein Municipality is managing this facility well.
