With regard to the illegal occupation of erf 606 in Gouda, Drakenstein:
(a) What action has been taken to address the illegal occupation and (b) what are the details of the action that has been taken?
(a&b) It was established that the Municipality applied for an eviction order as well as a Rule Nisi order that was granted on 30/3/2017. The court date for the Eviction Application was set for 13/6/17 and arguments from both sides were heard on the day.
Judge Dlodo emphasized that the Court had a very difficult task as the respondents would be rendered homeless if they were to issue an eviction order. In view of the fact that the municipality was unable to provide alternative accommodation, the court dismissed the application.
The municipality did not pursue the matter further after the Courts decision.
In terms of the current situation, the municipality is in the process of providing rudimentary services (water and sanitation) to the area.
