The right of Members to put questions to Ministers is an important part of ensuring the executive authority’s accountability to the Provincial Parliament.   1. (a) Why has there been a lack of response from him to the accusations made by the current acting Municipal Manager of the George Municipality that the appointment process for the Municipal Manager was unfair due to bias against and favouritism towards a specific candidate;

With regard to the tender awarded by his Department to a certain company, whose name has been furnished to his Department for the purpose of his reply, in order to provide IT services to public schools in the province:

(1)     Whether he is aware of any forensic report concerning that tender that revealed discrepancies, including unfair advantages given to the winning bidder; if so, what are the relevant details;

(2)     whether the State Information Technology Agency (SITA) warned or alerted his Department at any stage to withdraw the tender; if so, what are the relevant details;

(3)     whether there was any court challenge initiated by either SITA or the national Department of Communications and Digital Technologies concerning the awarding of this tender to this company, if so, what are the relevant details;

(4)     whether the court challenge remains active; if not, when was it withdrawn; if so, what are the relevant details?

With regard to the School Learner Placement System in the Western Cape:

(1)     Whether school principals have unfettered power or authority to deal with learner placement at schools as they wish; if so, what are the relevant details;

(2)     what is the recourse for learners and parents to his Department where a learner has been placed on a school’s waiting list until space becomes available but, when a space becomes available, the principal accepts a learner who was never on the waiting list;

(3)     what is the turnaround time in which his Department processes and finalises learner placement appeals;

(4)     how many learner placement appeals lodged with his Department in 2024 (a) were upheld in favour of the appellants and (b) have been dismissed?

  1. Whether he can provide a detailed list of all illegal land invasions reported in the province since 2019;
  2. whether his Department has, in collaboration with relevant authorities, conducted or initiated any investigations into these illegal land invasions; if so, at what stage are these investigations;
  3. who are the owners of each parcel of land affected by these illegal invasions, (b) what were the original plans or projects intended for the land in question and (c) how has these plans been affected or delayed by the land invasions;
  4. (a) what is the estimated value of the land and/or the intended projects for each site on which illegal invasions have had an impact, (b) what actions have been taken by the Department and municipalities to prevent further land invasions in the province and (b) what support is provided to municipalities that are dealing with these invasions;

whether he can outline any future strategies or policies aimed at addressing and mitigating the occurrence of illegal land invasions across the province?

In relation to succulent poaching in the Western Cape:

(a) What has been the outcome of succulent poaching investigations that have been completed by CapeNature staff and handed over to the NPA in the last three financial years, (b) how many (i) illegally harvested succulent plants have been seized by CapeNature staff in the last three financial years and (ii) plants are seized on average in each case and (c) what additional support is needed to put an end to succulent poaching;
  2. whether it is possible for seized plants to be salvaged and replanted; if not, why not; if so, what are the relevant details?
