Questions and Replies

The right of Members to put questions to Ministers is an important part of ensuring the executive authority’s accountability to the Provincial Parliament. Questions may be put to Ministers related to their spheres of responsibility. Replies to questions are either given orally in the House or in writing. The replies to oral questions are recorded in Hansard.

    1. what exact support, such as resources and consultation, does the MER project offer the Municipality;

 

    1. when does the Municipality envision that it will complete its investigations into alternative energy supplies;

 

    1. whether a working document has been developed on the matter; if so, can a copy be provided?

With regard to the illegal invasion of land owned by subnational governments in the Western Cape:

    1. (a) How many vacant parcels of land have been illegally occupied since March 2020 that are owned by the (i) Western Cape Government and (ii) City of Cape Town and (b) how many of these invaded parcels of land were earmarked for housing development by the (i) Western Cape Government and (ii) City of Cape Town;
    1. whether housing opportunities have been lost to illegal land invasion; if so, (a) how many and (b) what are the relevant details;
    1. (a) what steps has his Department taken to address the continued illegal invasion of vacant land parcels owned by the (i) Western Cape Government and (ii) City of Cape Town and (b) how much money has his Department spent on protecting vacant land parcels from illegal occupation in (i) 2018/19, (ii) 2019/20 and (iii) 2020/21 to date?

With regard to the Human Settlements Development Grant (HSDG) and the Urban     Settlements Development Grant (USDG):

With regard to the sexual harassment case against the traffic chief and after it has been learnt that the victim of this GBV case has been so traumatised that she has had to receive outside assistance as none was offered by the very department meant to protect her and that she is now allegedly being victimised further in that she is alleged to be going through a “competency hearing”:

 

  1. (a) Why was the perpetrator not placed on leave while the investigation was ongoing and (b) why has his Department not provided any counselling intervention for the family;

 

  1. whether the victim is being put through a “competency hearing”; if so, why;

 

  1. how many cases of sexual harassment has been made with in this department from 2010 to date;

 

It has been alleged that there are staff members who have been promoted after being sexually harassed:

 

  1. whether he is aware of any such persons in the Department; if so, what are the relevant details;

 

  1. (a) what remedial action will be put in place for victims to come forward and (b) what will he do to protect any whistle-blowers in his Department?

With reference to the reply to question 1 of 12 February 2021 received from the Minister of Transport and Public Works in point (3) that the CTICC had been decommissioned and that the details of the equipment had been compiled and distributed by the Department Health:

 

  1. What are the names of the organisations that benefitted;

(a) who was accommodated at the following facilities: (i) Lagoon Beach Hotel, (ii) Houwhoek Hotel, (iii) Bidvest Properties, (iv) CTICC, (v) Protea Hotel Durbanville and (vi) Reeds Country Lodge in the period April to September 2020 and (b) can copies of the close-out reports for each of these facilities be provided?

In the early hours of 1 July 2021, a retention pond near an informal settlement area, Bloekombos, burst its banks spilling raw sewerage into the surrounding houses and causing damage to property and creating an environmental hazard: 

(a)  Whether the Minister or his Department has taken any action as a result of this incident; if not, why not; if so, what are the relevant details, (b) if action was taken, against whom was the action taken and what are the relevant details, (c) what investigations have been done into the cause of the burst or spillage and what was the outcome, (d) what role did the City of Cape Town’s maintenance or failure of maintenance play, (e) why would a burst retention pond, intended to retain stormwater runoff, result in a sewerage spill, (f) how has the Western Cape provincial government’s Department of Environmental Affairs assisted the community of Kraaifontein, (g) whether the Minister’s Department visited the site and assessed the damage; if so, what are the relevant details, (h) whether the area been sanitised and (i) what caused the dam to burst?

With reference to point 3(1) in the Minister’s response to question 3 of 5 February 2021: “An investigation was conducted by an independent investigator who found no evidence of misconduct on the part of the ‘former Director’.”

 

  1. Whether this certain person, whose name has been furnished to his Department for the purpose of his reply, is no longer a Director in the Stellenbosch Municipality; if so;

 

  1. whether he resigned, retired, was dismissed or left the Municipality for another reason;

 

  1. if he left the Municipality for another reason, why is he being referred to as a “former Director”;

 

  1. if he is no longer employed by the Stellenbosch Municipality, whether the Minister is aware of his employment by any other Western Cape municipality; if so, where;

 

The Minister replied that a certain other person, whose name has been furnished to his Department for the purpose of his reply, is still employed by the Municipality but has been transferred from the post to another “for which she did qualify”. This confirms that she was not qualified for the position in which she was initially appointed:

 

  1. (a) why is this certain other person, whose name has been furnished to his
          Department for the purpose of his reply, being given special  treatment, (b) how is this certain other person related to an Alderwomen, whose name has been furnished to his Department for the purpose of his reply,  and

(c) how is this certain other person related to a person, whose name has
      been furnished to his Department for the purpose of his reply, who is
     also related to this case;

 

At a special meeting of the municipal council it was highlighted that two staff members of the Human Resource Department, whose names have been furnished to his Department for the purpose of his reply, who had been present in this interview, did not understand their roles and responsibilities with regard to the recruitment of staff:

 

  1. (a) what are the qualifications of these two staff members, (b) why does a senior manager and a HR professional not understand HR processes, employment equity and a fair recruitment processes and (c) why did the municipal council resolve that this did not amount to misconduct or incapacity and did not proceed with disciplinary processes;

 

  1. (a) what allegations did a certain councillor, whose name has been furnished to his Department for the purpose of his reply, make during this special council meeting with regard to this matter and (b) can he a copy, record or minutes of these allegations be provided?
