The right of Members to put questions to Ministers is an important part of ensuring the executive authority’s accountability to the Provincial Parliament. In respect of the 31 specialised high-performance vehicles that were handed over by the Minister to provincial traffic law enforcement officers in September 2023:

  1. (a) How many vehicles have not yet been handed over, (b) when are they expected to be handed over, (c) what has caused all the delays and (d) how will the remaining vehicles be distributed per municipality;
  2. whether the provincial government incurred any additional costs due to the delays in the preparation and handover of these vehicles; if so, what are the relevant details?

In respect of the incidences of racism in the province, especially in the hospitality industry in and around Cape Town:

  1. Whether the Consumer Protection Office and/or the Consumer Affairs Tribunal received any racism-related complaints in the past 12 months; if so, what are the relevant details;
  2. (a) under whose jurisdiction do complaints of racism fall and (b) how can affected consumers report these complaints, such as in the case of Mr Zwai Bala who was recently allegedly called the K-word in a restaurant in Gordon’s Bay?

In the light of the information received from the Consumer Protection Office during its appearance before the Standing Committee on Finance, Economic Opportunities and Tourism on 22 January 2024 that the Consumer Affairs Tribunal has not been operational for a number of years:

(a)   For how many years was the Tribunal not operational, (b) what led to it to be not functional, (c) during this period of non-functionality, how were consumer investigations attended to, (d) in respect of the legal prescripts guiding the work of the Tribunal, (i) how is the alignment done between national and provincial legislation and (ii) which takes precedence, (e) what is the rationale for the skills collaboration with the National Youth Development Agency (NYDA) that seems to be not about consumer affairs but about general skills development and (f) what mechanisms are in place to mitigate political and business interests and/or influence over of capture of the Tribunal?
