- How many municipalities in the province have been placed under administration
over the last five years and (b) which municipalities are these?
Answer Body:
Two (2) municipalities were subject to section 139 of the Constitution
interventions in the last five years.
- Kannaland Municipality is the only Municipality in the Western Cape currently under a section 139 of the Constitution intervention. The Provincial Executive resolved on 5 December 2018 to assume responsibility for the implementation, in its entirety, of the approved financial recovery plan, given that the Municipality cannot take the executive measures necessary to ensure the proper implementation of the said plan.
An Administrator (Financial Recovery) has been appointed with all powers and functions reasonably necessary to ensure the proper implementation of the approved financial recovery plan.
In addition to the above, a section 139 of the Constitution intervention in Oudtshoorn Municipality occurred in the last 5 years but ended on 10 August 2016, when the Independent Electoral Commission (IEC) declared all municipal councils elected thereby causing the section 139 intervention in Oudtshoorn Municipality to formally terminate.
