With reference to the Ladismith Municipality:

(a) What is the total amount spent on maladministration and fruitless and wasteful expenditure in the (i) 2016/17, (ii) 2017/18 and (iii) 2018/19 financial year, (b) how many disciplinary cases (i) are currently active and (ii) have been completed in 2018/19, (c) how many people have been employed since the Municipality was put under administration by his Department and (d) what is the breakdown in terms of (i) positions, (ii) salary scales and (iii) names of the employees?

Answer Body: 

      The town of Ladismith falls within the Kannaland Municipal area. I will therefore make reference to the Kannaland Municipality when responding to the above question.

      Please note that, in regard to potential maladministration matters, a number of cases have been opened with the relevant authorities which are under investigation and disclosure of which, at this stage, has the potential to prejudice the investigations.

        (b) (i)    Two (2) active disciplinary cases.

         (ii)   Four (4) completed disciplinary cases.

      (c)    Forty-six (46) people (inclusive of learner/interns) have been employed since the Provincial Executive assumed responsibility, in terms of section 139(5)(c) of the Constitution, for the implementation of the financial recovery plan, three of which are permanent appointments, two are section 56 appointments, six learner/intern appointments and the remainder are contract appointments in order to deal with temporary capacity requirements.

 (d)    The following positions were filled:

Note: In accordance with Cabinet resolution of 23 April 2014, relating to the uniform approach to deal with requests for sensitive and personal information by Standing Committees of the Western Cape Provincial Parliament, and on the advice of Legal Services and noting that the employees in question are Municipal employees and not Provincial Government employees, the names of the below persons employed at the Municipality have been withheld.

Section 56 appointments

•  Chief Financial Officer (level s56 appointment)

•  Director: Infrastructure Services (level s56 appointment)

Permanent:

•  Superintendent: Mechanical (level 11)

•  Traffic Officer (level 10)

•  Cashier (level 6)

New and Permanent appointments (since October 2019)

  • Accountant reporting (level T14)
  • Manager BTO (level T16)

1-3-year contracts:

•  Learners x 6 (contract end date 31/08/2020 referred to in question 4)

Contracts under 12 months:

•  Twenty-seven (27) temporary workers (General Workers) were reinstated for a period of 9 months following a settlement agreement which was concluded prior to the Provincial Executive assuming responsibility, in terms of section 139(5)(c) of the Constitution for the implementation of the financial recovery plan. (contract end dates 30/09/2019)

•  Fire fighter x 3 (3 months) (contract end date 30/09/2019) (level R4500 stipend) (Contract extended until 30 January 2020)

•  Senior Clerk: Credit Control (3 months) (contract end date 30/09/2019) (level T8)

•  Clerk: Credit Control (3 months) (contract end date 30/09/2019) 

•  Secretarial (3 months) (contract end date 31/05/2019) (level T6)
