What is the process for the transfer of land to the Housing Development Agency (HDA) for the purpose of human-settlement projects in cases where the land is owned and/or managed by the (a) national government and (b) provincial government?

Answer Body: 

The transfer of land is done in terms of the Deeds Registry Act, 47 of 1937.

Prior to the land being released to the Housing Development Agency, the following process is to be followed;

(a) Approval for the transfer of land from the National Government must be obtained from the National Minister of Public Works;

(b) Approval for the transfer of land from the Department of Transport and Public Works must be obtained from the Western Cape Cabinet, whilst the approval for the transfer of land from my department is delegated to the Head of Department by the MEC for Human Settlements.
