(b) What are the details of all 106 investigations undertaken by his Department in (i) 2018/19, (ii) 2019/20 and (iii) 2020/21 to date, (b) what is the current status of each of these investigations and (c) what were the outcomes and actions taken for all those investigations that have been finalised?
(a)(i) No section 106 investigations were undertaken by my Department of Local Government in 2018/19.
Bitou Municipality
I, as Provincial Minister responsible for Local Government, initiated a section 106 investigation in Bitou Municipality and the report containing findings and recommendations was provided to the Municipality in 2019.
(b) The investigation has been concluded.
(c) A number of persons were implicated in wrongdoing. The s106 investigation report was tabled before the Municipal Council. The Municipality has appointed an attorneys firm to inter alia develop the process (process plan) of responding to the provincial investigation report issued and attend to the findings and recommendations recorded in the report. The attorney’s last provided a status update on their progress on the 30 June 2020. A copy of the s106 investigation report was handed over to the HAWKS.
(a)(ii) No section 106 investigations were undertaken by my Department of Local Government in 2019/20.
George Municipality
I, as Provincial Minister responsible for Local Government, initiated a section 106 investigation in George Municipality and reports containing findings and recommendations were issued in three parts, namely Part A, B and C, and provided to the Municipality in early 2020.
(b) The investigation has been concluded.
(c) A number of persons were implicated in wrongdoing. The Part A s106 investigation report was tabled before the Municipal Council in early 2020. Part B and C were recently tabled before the Municipal Council which resolved to deal with the recommendations in the reports. Copies of the s106 investigation reports were handed over to the HAWKS. A number of persons implicated in the s106 reports were summonsed to appear in court on
9 October 2020, after the HAWKS concluded their investigation with the benefit of the s106 investigation reports.
Central Karoo District Municipality
I, as Provincial Minister responsible for Local Government, initiated a section 106 investigation in Central Karoo District Municipality and the report containing findings and recommendations was provided to the Municipality in October 2020.
- The investigation has been concluded.
- A number of persons were implicated in wrongdoing. The s106 investigation report has yet to be tabled before the Municipal Council. A copy of the s106 investigation report was handed over to the HAWKS.
(a)(iii) No section 106 investigations were undertaken by my Department of Local Government in 2020/21 to date.
George Municipality
I, as Provincial Minister responsible for Local Government, initiated a further section 106 investigation in George Municipality.
(b) The investigation is still ongoing.

Matzikama Municipality
I, as Provincial Minister responsible for Local Government, initiated a section 106 investigation in Matzikama Municipality.
(b) The investigation is still ongoing.
