(1)   Whether summons have been issued against the principal and the school governing body (SGB) of the Grove Primary School; if so, what are the (a) details of the summons and (b) transgressions of the parties involved;

(2)   whether there is any money that is meant to be recovered by the WCED from the principal and SGB; if so, (a) how much is the money and (b) how was it calculated;

(3)   whether there were any delays between her Department concluding the internal investigation and the issuing of the instructions to the state’s attorneys; if so, what are the relevant details?

Answer Body: 

          (1)     Yes, a summons has been issued.

(a)    Wynberg Magistrate’s Court, Case number: 16290/19

(b)    Transgressions of section 38A of the South African Schools Act

(2)     Yes, money is meant to be recovered.

  1. Claim 1: R24 802.20 and Claim 2: R142 406.00;
  2. The amounts represent the difference between the remuneration of the principal authorised by the Western Cape Education Department and the remuneration actually paid. The previous School Governing Body is jointly and severally liable.

(3)     There were no delays between the Department concluding the internal investigation and the issuing of instructions to the State Attorney.
