Finance and Economic Opportunities
The Western Cape office of the Department of Employment and Labour reported that there are 30 000 non-compliant employers in the province who do not register, who do not declare all and/or only some of their employees, or who deduct UIF from employees but do not pay such monies to the UIF:
Whether this has been brought to his attention; if so, what are the (a) relevant details and (b) details of the remedial action taken by his Department?
a) No, it was not brought to the attention of the Minister.
b) The Minister does not have the mandate or legal authority to take remedial action against the business sector for not being compliant with the Department of Employment and Labour as it relates to UIF. The Department has a role to assist in removing barriers as it relates to red tape for businesses. One of these interventions is the interpretation of regulations around the TERS fund. The department furthermore follows up on blockages related to the TERS fund application process for Western Cape based businesses. Potential challenges experienced by businesses are escalated by this Department to the Department of Employment and Labour, as this is within its mandate.
