With reference to his reply to interpellation 1 of 2 September 2021
(1) (a) what are the details of officials in his Department that are handling the investigation and (b) their positions;
(2) with regard to allegations he received as per his reply; (a) what is the (i) number and (ii) details of (aa) City Contractors and (bb) City officials that are implicated in the allegations, (b) what is the (i) number and (ii) details City Contractors who allegedly inflated invoices and (c) how much was lost due to this alleged fraud, (d) what is the (i) number and (ii) details of City officials implicated in the Tender manipulation allegations and (e) what are the details of Ward councillors accused of money laundering?
(1)(a) No s106 investigation has been initiated to date in relation to the allegations at the City of Cape Town.
(1)(b) No officials of the department have been designated in terms of s106 to conduct an investigation in relation to the allegations at the City of Cape Town.
(2)(a)(i)(aa) Two (2) contractors have allegedly inflated invoices.
(2)(a)(i)(bb) Two (2) City officials (only one of which is still employed at the City of Cape Town) are implicated in the allegations.
(2)(a)(ii)(aa) In accordance with the Cabinet resolution of 23 April 2014 requests for information relating to forensic investigative matters will be treated with circumspection, given the potential risks associated with the disclosure of such.
I must unfortunately refuse the request by the member in this public forum as its disclosure has the potential, at this stage, to prejudice the assessment and investigation of a contravention or possible contravention of the law, or enable a person to ascertain the identity of a confidential source of information or result in the intimidation or coercion of a person who might be called as a witness.
Moreover, the provisions of section 26 of the Protection of Personal Information Act, 2013 (POPIA) prohibits the processing (including the disclosure) of special personal information which amongst other include information concerning criminal behaviour of persons to whom the information relates to the extent that the information relates to (as in this instance) the alleged commission of any offence by that person or any proceedings in respect of any offence allegedly committed by that person or the disposal of such proceedings unless authorised to do so in terms of sections 27 or 33 of POPIA.
I must unfortunately refuse the request by the member in this public forum as I am prohibited from doing so in terms of the provisions of POPIA aforementioned and any disclosure would fall outside the scope of sections 27 and 33 which would otherwise allow disclosure of such information despite the prohibition.
