With reference to CAS 266/11/2020:

 

  1. Whether this case has been referred to the Western Cape Police Ombudsman for investigation; if so, what is the outcome; if not,

 

  1. whether he can refer this case accordingly; if not, why not; if so, what are the relevant details?
Answer Body: 

The Western Cape Police Ombudsman (WCPO) informed me as follows:

10.   (1)   There was no official complaint lodged in this regard. Section 15 (a) of the Western Cape Community Safety Act (WCCSA) of 2013, (Act 3 of 2013) states that the Western Cape Police Ombudsman must receive and investigate complaints submitted in terms of section 16 of the WCCSA. The WCCSA is being reviewed to allow for the WCPO to initiate investigations.

Yes, the Minister, or any other member of the Provincial Parliament, can refer the complaint in terms of section 16 (2) of the Western Cape Community Safety Act of 2013.
