With reference to AR 33/02/2021 Kirstenhof:

 

  1. What is the status of this incident;

 

  1. whether any charges have been brought in respect of this AR number; if not, why not; if so, what are the relevant details;

 

  1. whether a blood-alcohol sample was taken from the driver of the vehicle; if not, why not; if so, what are the relevant details;

 

  1. whether (a) the victim requested a blood-alcohol sample be taken and (b) witnesses claimed the driver was under the influence of alcohol; if so, what are the relevant details;

 

  1. (a) at what speed the vehicle was travelling when it crashed into the rear-end of the other vehicle and (b) what is the speed limit of the road on which the crash occurred;

 

  1. whether the SAPS considers the scene to be contaminated if paramedics attended to an injured person at a crash site; if so, what are the relevant details?
Answer Body: 

The South African Police Service informed me as follows:

4.      (1)   The accident was reported on 2021-02-12 at 22:20.

          (2)  No criminal case was reported as there were no serious/fatal injuries.

          (3)  No blood alcohol sample was taken as no criminal case was opened.

                 (4)  (a)     The member who attended the accident scene interviewed the driver of the vehicle and had no reason to believe that the driver was under the influence of alcohol or any other intoxicating substance. The other driver sustained a fracture to the foot and was transported to hospital and was not interviewed by the member.

                 (b)     See response to 4 (a).

 

          (5)  (a)     It was not reported to SAPS.

                 (b)     Speed limit is 60 km/h.

                            (6)  For the reasons referred to above, the attending member did not deem the accident scene as a crime scene.
