With regard to the arrest of an individual for the illegal sale of canned pilchards of the National School Nutrition Programme at a shop in Retreat in 2021 (CAS 276/01/2021):
- Whether the individual has been released on bail; if so, what are the relevant details, (b) when will the case proceed to court and (c) what is the reason for the delay?
The reply of the South African Police Service (SAPS):
5. (a) The accused was released on a SAPS 496 (warning to appear in court) after consultation with the Senior Public Prosecutor, Mr Pillay of Wynberg Magistrate Court.
(b) The case, Steenberg CAS 276/01/2021 was withdrawn in court on the 1st appearance on the 26th of January 2021 by the prosecutor due to there being no prospect of a successful prosecution based on the following:
- No case of theft was opened related to the stolen goods; and
- After SAPS confiscated the goods, the presumed stolen property was not claimed by the owner.
