With regard to the arrest of an individual for the illegal sale of canned pilchards of the National School Nutrition Programme at a shop in Retreat in 2021 (CAS 276/01/2021):

  1. Whether the individual has been released on bail; if so, what are the relevant details, (b) when will the case proceed to court and (c) what is the reason for the delay?
Answer Body: 

The reply of the South African Police Service (SAPS):

5.      (a)  The accused was released on a SAPS 496 (warning to appear in court) after consultation with the Senior Public Prosecutor, Mr Pillay of Wynberg Magistrate Court.

        (b)    The case, Steenberg CAS 276/01/2021 was withdrawn in court on the 1st appearance on the 26th of January 2021 by the prosecutor due to there being no prospect of a successful prosecution based on the following:

  • No case of theft was opened related to the stolen goods; and
  • After SAPS confiscated the goods, the presumed stolen property was not claimed by the owner.

         (c)   Not applicable
