Whether the court case of a certain person, whose name has been furnished to his Department for the purpose of his reply, has been brought to his attention; if so, (a) what are the relevant details, (b) when was this brought to his attention and (c) why has this person not been suspended pending the outcome of the investigation?
I am aware that the person, whose name has been furnished, has appeared in the Magistrate’s Court.
(a) I am not privy to any details.
(b) It was brought to my attention through media reports at various times.
(c) As has previously been indicated, in terms of Chapter 7 of the SMS Handbook, the employer may suspend or transfer a member on full pay if –
- the member is alleged to have committed a serious offence; and [own emphasis]
- the employer believes the presence of a member at the workplace might jeopardise any investigation into the alleged misconduct, or endanger the well being or safety of any person or state property.
Currently, there is no investigation being undertaken by the Department in relation to the court case.
