What impact will section 25 of the Constitution, which relates to land expropriation without compensation, have on the Western Cape Government’s vision of transferring more title deeds to the people of the Western Cape?
Section 25 of the Constitution speaks directly to security of tenure of land based on property rights. As the committee tasked by the President to introduce legislation to amend Section 25 of the Constitution has yet to conclude or publicise their recommendations, there is currently no other impact on the Western Cape Government’s vision of transferring more title deeds to the people of the Western Cape.
Since 2009, 103 000 people have received title deeds across the Western Cape and can proudly call themselves homeowners. In every financial year of the current term, the Western Cape has exceeded its title deed delivery targets by at least 2000. This has aided in reducing poverty as beneficiaries are now property owners. The success has been made possible by a dedicated team tasked to expedite the transfer of title deeds in the Western Cape.
