Since the promulgation of the Western Cape Liquor Act, 2008 (Act 4 of 2008) for the financial years (a) 2009/10, (b) 2010/11, (c) 2011/12, (d) 2012/13 and (e) 2013/14, how many (i) illegal liquor outlets have been raided, (ii) litres of liquor have been seized, (iii) litres of liquor have been destroyed, (iv) litres of liquor have been returned to illegal liquor outlet proprietors, (v) of these proprietors have been arrested and (vi) have been prosecuted under the Act?

9.         The South African Police Services (SAPS) informed me as follows:   

(a) – (c)                      Not applicable

(d)       (i)                    37817 raids conducted at illegal liquor outlets bearing in mind that outlets could be raided more than once.

(ii)                   2 158 253 Lt

(iii)                  703 616.811 Lt

(iv)                  22373.87 Lt

(v)                   4522

(vi)                  This requires the perusal of individual cases on the Crime Administrations System (CAS) which is a labour intensive process and would require a further extension on the response to this question for such analysis to be completed. (Note: this outstanding question will be answered by SAPS on the 31 October 2014)

(e)       (i) – (vi)          The required information pertains to case dockets (hence crime statistics) hence, no information can be provided as the Minister of Police is due to release the crime statistics for 2013/2014 on 2014-09-19. (Note: this outstanding question will be answered by SAPS on the 31 October 2014)

FOOTNOTE:

The crime code used to extract information on the Western Cape Liquor Act 4/2008 includes all cases related to the Liquor Act and not only to illegal dealing in liquor.

These cases also include sub-articles such as (to mention a few) out of the 98:

  • “Failure to attend a meeting after having been summonsed i.t.o an offence”
  • “Liquor may not be delivered from any vehicle unless the liquor was ordered from a licensed premises before the despatch of liquor and invoice issued in prescribed manner”
