With regard to the newly established departments of Infrastructure and Mobility:
(1) What is the (a) budget allocation for each of these departments and (b) budget breakdown per programme;
(2) whether, with regard to the budget allocation that was passed by the provincial parliament for the 2022/23 financial year, any allocations were made to these new departments; if not, what laws and regulations permitted the redetermination of the provincial budget with no consultation of the provincial legislature to allocate budgets to these new departments; if so, what are the relevant details;
(3) whether she or her Department has sought any legal advice on the redetermination of the provincial budget to make allocations to the new departments; if so, what are the relevant details?
With regard to the newly established departments of Infrastructure and Mobility:
[1] What is the [a] budget allocation for each of these departments and [b] budget breakdown per programme;
[a] No budget allocations have been made to the two new Departments in the 2022/23 financial year. The two new Departments will be established during the 2022/23 financial year to operate from the 2023/24 financial year.
[b] No budget per programme exists for the two new Departments yet as this will only be allocated in the 2023/24 financial year once the Departments begin operations.
[2] whether, with regard to the budget allocation that was passed by the provincial parliament for the 2022/23 financial year, any allocations were made to these new departments; if not, what laws and regulations permitted the redetermination of the provincial budget with no consultation of the provincial legislature to allocate budgets to these new departments; if so, what are the relevant details;
No allocations were made to the new Departments for the 2022/23 financial year. The allocations to the Departments of Transport and Public Works and Human Settlements remain in place for this financial year.
[3] whether she or her Department has sought any legal advice on the redetermination of the provincial budget to make allocations to the new departments; if so, what are the relevant details?
No legal advice has been sought since no allocations have been made to the new Departments. The establishment of the two new Departments including the respective budgets will form part of the budget process for the 2023 budget.
