Community Safety
With reference to the incident of police brutality involving a Nigerian man who was assaulted in Riebeek Street, Cape Town, in March 2014:
- What disciplinary action, if any, was taken against the South African Police Service officers involved;
- whether the Independent Police Investigative Directorate (IPID) investigated the matter; if not, why not; if so, (a) who did the IPID investigate and (b) what were the outcomes of the investigation;
whether any recommendations of the IPID investigation were followed; if not, why not; if so, what are the relevant details?
The Independent Police Investigative Directorate informed me as follows:
- Disciplinary action has been taken against both SAPS members and Disciplinary outcome are as follows:
Accused number 1 was dismissed and Accused number 2 resigned.
(2)(a) The case reported as Cape Town Central CAS 534/03/2014, CCn 2014030158 Assault GBH, was investigated by IPID and finalised in court on 24 February 2017. The victim of Assault is a Nigerian Citizen.
(b) The criminal outcome was as follows:
Accused Nr 1: sentenced to 3 years correctional supervision
Accused Nr 2: sentenced to 2 years imprisonment, suspended for 4 years on condition that the accused is not convicted of any crime involving violence in the period of his suspension and a further 12 months without an option of a fine. In addition the accused is sentenced to 2 years correctional supervision in terms of Sect. 276 (1)(h) of Act. 51 of 1997.
(3) IPID recommended that both accused 1 and 2 be charged criminally and departmentally.
