With reference to Domestic Violence Protection Orders in the Western Cape:
[1] How many (a) (i) were applied for and (ii) were issued during the (aa) 2014/15, (bb) 2015/16 and (cc) 2016/17 financial years, (b) of those who applied, how many were (i) women and (ii) men, (c) were withdrawn (i) before the court date and (ii) at the court hearing and (d) were contravened;
[2](a) what is the number of conviction and (b) how is his Department ensuring that victims of abuse who have taken out protection orders, do get the necessary support form the relevant stakeholders?
The Department of Justice and Constitutional Development informed me as follows:
[1] The Department of Justice and Constitutional Development (the Department) collects statistics in domestic violence matters through the Integrated Case Management System (ICMS) which tracks down a case from the entry point into the court system up to finalization. Currently, the ICMS does not categorise as to whether the application was withdrawn before the return date or during the hearing. This is a gap in the system that will be considered for correction when the ICMS is upgraded. The Table below gives the depiction of the statistical data required:

Kindly note that the ISCM could not generate statistics on interim protection orders for 2016/2017 financial year because of system challenges. This matter is being rectified.

During the financial years 2014/2015 and 2015/2016, no gender-aggregated data was collected due to system’s limitations. It was only in April 2016 when Department rolled out its improved ICMS that is now collecting data according to gender.

[2](b) The Department established and chairs the National Intersectoral Committee on Domestic Violence to monitor the integrated implementation of the Domestic Violence Act, 1998 (Act No 116 of 1998). This Committee is constituted by the South African Police Service, National Prosecuting Authority, Departments of Social Development, Health, Correctional Services, Women, Cooperative Governance and Traditional Affairs, and the civil society organizations. As part of its mandate, the Committee seeks to address challenges that block the provision of sequential and coordinated value support services to the victims of domestic violence. However, it remains the responsibility of each stakeholder to ensure that victims receive the necessary support after they have been granted with the Protection Order. For instance, the Civilian Secretariat for Police Service monitors and evaluate compliance with the Domestic Violence Act, 1998 (the Act) by its members, and further makes recommendations to the police service on disciplinary procedures and measures with regard to non-compliance with the Act.
