(a) What (i) is the total amount that has been transferred to the City of Cape Town for the Law Enforcement Advancement Plan (LEAP) from the inception of the plan to date, and (ii) oversight mechanisms are in place to hold the City of Cape Town accountable for the transferred funds, (b)(i) what are the details of the contractual obligations that have been entered into between the provincial government and the City of Cape Town with regard to LEAP and (ii) can copies of all documents and/or agreements and/or contractual obligations entered into be made available and (c) what mechanisms are in place in order for his Department and the Standing Committee on Community Safety to hold the City of Cape Town to account for the transferred funds for the LEAP programme?

[a]     [i]  The amount transferred to the City of Cape Town municipality for the Law  Enforcement Advancement Plan [LEAP] project is R712 250 000.

                   For the 2022/23 financial year the amount for the LEAP is R400 000. The funds to be transferred in August 2022.

         [ii]  The Transfer Payment Agreement [TPA] and Law Enforcement Advancement Plan [LEAP] accommodates robust reporting and intergovernmental relations through the LEAP     Governance. The TPA recommends quarterly financial reports and implementation progress reports.

  [b]  [i] The contractual agreement is related to the LEAP Business Plans and the TPA are finalised annually.

        [ii] See attached Annexure 1

[c]  The Department of Community Safety [DoCS] legislative framework is derived from the LEAP Gazette that is tabled annually. The Gazette sets out monitoring requirements for the beneficiary institution and has an effective oversight and monitoring requirement for the funding Department [DoCS]. The Gazette is supported by the TPA in accordance with the Public Finance Management Act [PFMA] and Municipal Finance Management Act [MFMA]. Furthermore, the DoCS initiated a Section 35 IGR Governance & Protocol Agreement to further strengthen the effective financial and resource management and governance of LEAP. The way in which the monitoring and oversight mechanism is implemented is detailed below:
