(1) Whether a certain person, whose name has been furnished to his Department for the purpose of his reply, served as Head of Office for the Minister of Human Settlements; if so, (a) what are the relevant details and (b) for how long did this person occupy the position;
(2) whether a request to appoint this person as Head of Office for the Minister of Transport and Public Works in 2019 was denied; if so, (a) on what basis was it denied and (b)(i) who was then appointed as Head of Office and (ii) on what basis was this person appointed?
1.Yes. She served as Head of Office for the Minister of Human Settlements for the period of 01/07/2014 up until 30/06/2019.
[a] She was appointed in 2014 in terms of Public Service Regulation 66 which provided for the filling of posts within offices of Executive Authorities by way of an appointment (without advertising) or by way of transfer.
[b] She served as Head of Office for the Minister of Human Settlements for the period 01/07/2014 up until 30/06/2019.
[2] In line with new national regulations and directives, the person mentioned could not be considered for the Head of Ministry post.
[a] Public Service Regulation, 2016 [as amended] 66 [2] indicates that subject to the appointment criteria, an Executive Authority may fill a post in the Office of the Executive Authority (without advertising). These 2016 regulations are to be read together with the DPSA Directive dated 11 November 2017 which stipulates what the inherent entry requirements are at SMS level [ie. the qualifications required].
These changes came into force in 2017, and do not affect employees who were hired before this time, as this would be prejudicial. They apply to all new appointees, post 2017.
At the 2019 elections, all the contracts of the ministerial staff, including that of the above-mentioned person, ended (they were linked to term, as is the requirement). The recruitment of new ministry staff was commenced after the election. Due to the above regulation change and new directive, which now applied, the person referred to above could not be considered for the above post as she did not meet the qualification requirements.
[b][i] Mr Clive Morgan Roos was appointed to serve as the Head of Office in the Ministry of Transport and Public Works.
