Police Oversight and Community Safety
Whether a witness to a fatal gang-related shooting who comes forward to testify is offered protection under a witness protection plan; if not, why not; if so, what are the relevant details?
The reply of the South African Police Service (SAPS):
2. The Witness Protection Act of 1998 (Act 112 of 1998) establishes an office for the protection of witnesses, and regulates the powers, functions and duties of the Director: Office for Witness Protection (OWP). The operations of the OWP are administered by the National Prosecuting Authority.
Applications for witness protection received by SAPS are referred to the OWP in terms of Section 7 of the Witness Protection Act, for further evaluation and administration.
