With reference to the appointment of the Head of the Department of Mobility:

  1. Whether the incumbent was vetted before the appointment was made; if not, why not; if so, (a) what was the extent of the vetting procedure undertaken and (b) which department undertook the vetting procedures;

(2)  whether the incumbent was a member of a board of directors of a state-owned entity, or a director in a government department prior to the appointment; if so, what are the relevant details;

  1. whether the incumbent has been implicated in any lawful investigation while being employed in the public service; if so, (a) what are the relevant details, (b) was this disclosed as part of the application and (c) when was it disclosed;
  2. whether the incumbent has any ongoing litigation in any court of law; if so, what are the relevant details;
  3. (a) who was present during the interview processes, (b) in which capacity did all the attendees act and (c) can a copy of the attendance registers be made available?

Board of directors of state-owned entities:

The incumbent was an ex-officio member of the Passenger Rail Association of South Africa (PRASA) Board, appointed in 2011 and served on the Board until 2014.

The incumbent was an ex-officio member of the South African National Road Agency Limited (SANRAL) Board, appointed in 2015 and served on the Board until 2016.

An ex-officio member is a member of a body, notably a board, committee or council, who is part of it due to holding another office. In the case of the incumbent, they were nominated as an ex-officio member, by National Treasury to both the PRASA & SANRAL Boards.

  1. (a) The incumbent was interviewed by the Investigative Leader for Research and other investigators of the Judicial Commission of Inquiry into Allegations of State Capture (Zondo Commission) in 2018.

While the incumbent was a member of the PRASA board they repeatedly raised a number of serious concerns about a range of issues unfolding at PRASA with the National Treasury. They and others raised serious concerns regarding governance and management at PRASA. This ultimately resulted in the incumbent’s resignation from the PRASA board.

In a report by the Public Protector following an investigation into the PRASA board it was recommended that the Board be further investigated.

(b) Prior to their appointment, on 22 May 2023, the incumbent informed the Western Cape Government of the recommendation by the Zondo Commission regarding the Board on which they served as an ex-officio member from the National Treasury.

Vetting results confirmed that no investigation was conducted whilst employed in the public service (i.e. in government departments).
