With regard to reports that the HOD of his Department is no longer in that post:

  1. Whether the former HOD of his Department has resigned; if not, what are the reasons for her leaving the post; if so, what are the reasons for her resigning;
  2. whether she is still employed by his Department; if so, (a) in what position, (b) what is the level of the position and (c) what is the job description;
  3. whether a recruitment process was undertaken for this post; if not, why not; if so, what are the relevant details;
  4. whether a copy of her assessments for (i) 2019/20, (ii) 2020/21, (iii) 2021/22 and (iv) 2022/23 can be made available?
Answer Body: 
  1. The former Head of Department (HOD) was Mr Gideon Morris whose contract came to an end. The current HOD is Advocate Yashina Pillay.

Advocate Pillay has not resigned. Advocate Pillay requested deployment into the Chief Director Security Risk Management post of the department based on the service delivery needs of the department at this time. The Premier and Minister have agreed to the deployment in terms of the Public Service Act which will allow her to further contribute to the strategic objectives of the department and the Western Cape Government.

         (2)  Yes, Advocate Pillay is still employed by the Department. See above for further information.

         (3)  Head of Department post – Recruitment process undertaken in 2020 and Advocate Pillay appointed in January 2021. See above for further information.
