Question by Hon Jacobs
With regard to the Manenberg School of Skills:
- Whether his Department was compelled by the Western Cape High Court to review a decision that prejudiced Fury Point Construction or other entities; if so, what are the relevant details;
- whether the Department is following the recommendations by the Western Cape High Court; if not, why not; if so, what is the outcome;
- (a) what are the reasons for the delay of this project and (b) who is responsible for the delay;
- whether any action has been taken against those who have made errors with the awarding the tender to H&I Civil and Building (Pty) Ltd; if not, why not; if so, what are the relevant details?
- The High Court declared as invalid the awarding of the contract and ordered the Department to reconsider its decision.
- Yes, the re-evaluation is in process. The department is not deviating from the court order.
- (a) The delay is due to the various system factors involved, from additional information required from bidders, time allowed for the Requests for Information to be addressed and Provincial Treasury budget approval for the project to proceed. (b) The department is in the process of concluding the tender re-evaluation process as soon as practically possible.
- Refer to 3 above which indicates that the Department is still processing the re-evaluation.
