The Standing Committee on Local Government, Environmental Affairs and Development Planning of the Western Cape Provincial Parliament invites stakeholders, interested persons and organisations to make submissions on the Western Cape Monitoring and Support of Municipalities Amendment Bill [B 8–2023] and the Independent Municipal Demarcation Authority Bill [B 14B–2022] (NCOP).
PURPOSE
The purpose of the Western Cape Monitoring and Support of Municipalities Amendment Bill [B 8–2023] is to amend the Western Cape Monitoring and Support of Municipalities Act, 2014 (Act 4 of 2014), so as to insert certain definitions; to provide for the Provincial Minister to require any municipality or category of municipality by notice in the Provincial Gazette to submit information to a specified provincial organ of state; to provide for access to records of a municipality during an assessment or an investigation by certain provincial functionaries; to provide for the designation of support officers to municipalities; to provide for the designation of a provincial support officer; to amend the provisions that provide for cooperation between a municipality and the Department; to provide for procedures for the proactive monitoring of municipalities; to provide for procedures for the inspection, securing and copying of records in specified circumstances; to provide for the Provincial Minister to direct a municipal council to conduct a preliminary assessment on receipt of certain allegations; to authorise the Provincial Minister to await the outcome of investigations by other organs of state prior to taking action under section 106 of the Municipal Systems Act or this Act; to amend the requirements relating to the assessment to be made by the Provincial Minister before invoking section 106(1) of the Municipal Systems Act; to amend the procedures when invoking that section; to delete certain reporting requirements; to provide for matters on which the Provincial Minister may make regulations; to introduce further offences; and to provide for incidental matters.
The purpose of the Independent Municipal Demarcation Authority Bill [B 14B–2022] (NCOP) is to provide for the establishment, functions and powers of the Independent Municipal Demarcation Authority; to provide for the criteria and procedures for the determination and redetermination of municipal boundaries; to provide for the delimitation of wards; to provide for the establishment of the Demarcation Appeals Authority; to provide for municipal capacity assessments; and to provide for matters incidental thereto.
SUBMISSIONS
Those persons interested in engaging with the Standing Committee may submit written submissions (email: jcoetzee@wcpp.gov.za) or make oral submissions by sending voice notes on WhatsApp (cellphone number: 072 521 6674), and they may also request to appear before the Standing Committee to make oral presentations.
All submissions and requests to appear before the Standing Committee must reach the Standing Committee by no later than Tuesday 22 April 2025.
