Have your say on Communal Property Association Amendment Bill

The Western Cape Provincial Parliament’s Standing Committee on Economic Opportunities, Tourism and Agriculture will conduct a series of public hearings focusing on the Communal Property Associations Amendment Bill [B 12B–2017] (NCOP). These public hearings will be conducted in accordance with the national Constitution and the Constitution of the Western Cape.

 

The Communal Property Associations Amendment Bill seeks:

 

  • to amend the Communal Property Associations Act, 1996 (Act 28 of 1996), so as to amend, insert and delete certain definitions;
  • to provide for clarity on the objective of communal property associations;
  • to provide for the establishment of a Communal Property Associations Office and the appointment of a Registrar of Communal Property Associations;
  • to provide for general plans for land administered by an association;
  • to repeal the provisions relating to provisional associations;
  • to provide improved protection of the rights of communities in respect of movable and immovable property administered by an association;
  • to provide for name changes of associations;
  • to improve the provisions relating to the management of an association that has been placed under administration;
  • to provide clarity on the content of an annual report in respect of associations;
  • to make provision for transitional arrangements; and
  • to provide for matters connected therewith.

Interested persons and organisations are invited to attend and to participate in the public hearings.

 

Written submissions and requests to make verbal presentations on such submissions must be directed to the Standing Committee’s Coordinator, Ms Zaheedah Adams (tel 021 487 1641 or email zadams@wcpp.gov.za). Requests to make verbal presentations at the public hearings must be submitted to the Committee Coordinator at least one day before the scheduled public hearing. Written submissions must be received by Tuesday, 13 November 2018.
